Poker et impôts en Espagne : l'angoisse

Comme vous le savez peut-être la loi de régulation est passée en Espagne il y a peu et maintenant tous les sites sont des .es
Je joue depuis juin donc sur PS.es, ça se passe plutôt très bien pour le moment mais hier un type sur le chat a posé la question des impôts et du coup je suis allé voir un peu sur les forums ce qui se dit à ce sujet… Et là, le choc : beaucoup de joueurs ES sont très inquiets et parlent même d’une grève étant donné l’absurdité de la loi espagnole.
En fait, il paraîtrait qu’il faut payer des impôts sur les gains, mais sans pouvoir déduire les pertes ! Non pas sur l’argent cash-out ou par rapport au montant de votre bankroll, en somme, mais sur chaque pot gagné ! En gros vous pouvez avoir un bénéfice net de juste 1000 par mois cash-outé ou pas, mais si dans ce même mois vous avez atteint 5000 en comptant tous vos pots gagnés et pas ceux perdus, les impôts s’appliqueraient en théorie sur ces 5000 ! Hallucinant, non ? Du coup, je ne suis pas certain de devoir continuer à jouer, dès lors que personne ne semble avoir l’info exacte, je me dis qu’il vaut mieux attendre la fin de l’exercice 2012 pour y voir plus clair, mais bon, ça craint d’arrêter de jouer pour ça…
Y a-t-il ici des joueurs qui résident comme moi en Espagne et qui ont des infos ?

Ouais, voilà…

Si par exemple je fais 100K hands en un an en NL100 et gagne 10K, la totalité des pots gagnés sans compter les perdus, ce serait quoi à peu près ? Un ordre d’idées ? 50K ? Mettons que les impôts me demandent 20% sur cette somme, soit 10K… Total des gains : 0 !!!

Après, la question c’est de savoir s’ils vont vraiment demander à PS les données sur les 50000 joueurs du site, passer tout ça au crible et réclamer de l’argent à tous les regulars selon ce mode de calcul absurde et proprement débile… qui fait que même un joueur perdant pourrait avoir à payer des impôts !!! Accrochez vos ceintures !

Dans un pays en crise et proche de la faiilite… obv qu’ils vont le faire et c’est tout a fait compréhensible.

Apres si tu vis du poker etc… bah alors va a l’étranger sinon oubli le poker ou alors seulement de maniere recreative

Je vis déjà à l’étranger, et je suis pas encore assez sûr de mon jeu sur le long terme pour envisager de changer de pays pour cette raison.

Quant à oublier le poker quand tout se passe bien, que les tables sont remplies de fishs, là tu m’en demandes trop !

ce n’est pas directement le sujet, mais depuis qu’il y a PS.EU les finlandais et suédois ne semblent plus avoir de raisons pour craindre le fisc

PS.es accepte les joueurs étrangers, mais il faut résider en Espagne je pense.

Et pokerstar.eu, acceptent les Français d’Espagne par exemple?

J’ai écrit à PS, ils vont m’envoyer les rapports avec lesquels je vais pouvoir calculer tous mes pots gagnés depuis l’ouverture du .es, juste histoire de voir à combien j’en suis par rapport à mes gains réels net

bueno ça devient comico-tragique : en appliquant le filtre “won hand” dans overall de HM2 j’ai “net won” 76K pour 12437 hands, alors qu’en réalité j’ai fait depuis juin 60K hands pour un modeste 4000 euros de gain… Soit gain brut/gain net on est dans un ratio de 19 pour 1 ! j’ose même pas imaginer les impôts si réellement ils appliquent leur système à la mords-moi-le-noeud…

Tantôt que j’aurais pas une réponse claire à ce sujet, je crois que la sagesse impose de faire une pause, non?

Il me semble que pas mal de regs ont arrêter ( voir se sont exilés ) à cause de çà.
Tu devrais aller sur des forums internationaux ( comme 2+2) pour avoir plus d’informations.
